Since the passing of laws that allow mesothelioma victims to sue companies for compensation if they believe they contributed to them developing mesothelioma, over six hundred thousand such cases have been filed. As a result, asbestos lawyers have a well-oiled machinery that they employ when tackling big companies who themselves employ a battery of high profile attorneys to defend them in mesothelioma cases.
However, since the burden of proof is on the plaintiff, it is best for victims of mesothelioma understand their rights and the processes when filing a mesothelioma claim. Mesothelioma claims are not restricted to only the victim. Many times these sufferers of mesothelioma are either incapacitated or dead. As a result, family members can file a mesothelioma claim on their behalf on the grounds of psychological suffering, loss of income, medical expenses and disability.
If you had a history of working in an environment where you were exposed to asbestos particles, and twenty to forty years have passed since that exposure, then you should be on the lookout for symptoms of mesothelioma. By recognizing these symptoms, you will be able to indicate them to your doctor for them to conduct the required test to determine your status. Some of these symptoms include fatigue, shortness of breath, chest pains and unexplained weight loss.If you have been diagnosed with mesothelioma, then you should quickly contact an asbestos lawyer to begin proceedings pertaining to your asbestos case.

The statutes governing asbestos claims will differ from state to another. Most states have implemented limitations on how long mesothelioma victims are allowed before they begin proceedings for their mesothelioma case. This statute of limitation begins from the point when the individual becomes injured. However, what makes it tricky is that because mesothelioma takes such a long time to develop, many states apply these statutes back to the time of any exposure to asbestos and by so doing, nullify any asbestos claim filed against companies. As a result, it important to contact an experienced asbestos lawyer who can successfully argue on your behalf.
The burden of proof in asbestos cases falls squarely in the laps of mesothelioma victims. Therefore, before filing your mesothelioma case, ensure that you have all relevant documents prepared about your employment history. In addition, secure a medical professional, preferably your personal doctor who can testify on your behalf about how the disease developed within your body.
Once your asbestos lawyer is satisfied that they have all the relevant information for a successful case, they will submit the case on your behalf. The court will then forward your claim to the defendant company and allow them time to review your claim and either accept it or file a counter suit.
Though each mesothelioma is unique, mesothelioma victims must expect for a long battle with these companies. In addition, if they are successful in their claim, be prepared for asbestos companies to appeal the ruling.

It is essential that prospective clients of the many law firms are aware of their rights and what they should expect from their lawyers before they even contact one.
I spent many years as an Accident and Liability Insurance Underwriter for Legal & General Assurance Society and later for AFIA, then the biggest Insurance company inn the world. Claims for pneumoconiosis in particular were surfacing in the 60s – 80s when I worked at Legal & General. It was only later when I worked at AFIA that I started to see the beginnings of Asbestosis as it was then known.
Obviously I was sitting in the opposite side of the fence in those days, as we were trying to mitigate the potential costs involved in this litigation.
My recommendation today would be to get the medical and work history established first, and then contact your lawyer of choice. My further suggestion would be to find one that has had success with this type of claim.

This article looks like another one I saw on ezine, but this version is a little cleaner and more concise. Well, Personal Injury stuff, especially in New York, is just like you say – “Never a good outcome”.
